Article 37 of the EU Charter of Fundamental Rights establishes environmental protection as a fundamental principle. Despite structural limits implied by its nature as a disability-immunity rule, Article 37 can arguably contribute to a full integration between environmental duties and fundamental rights via the establishment of an emerging human right to a sustainable environment at the regional and international level.
